What is a Fiscal Agent?


In the Virginia Medicaid Waiver system, a Fiscal Employer Agent (F/EA) plays a critical role in managing financial and administrative responsibilities related to the provision of services for individuals receiving Medicaid funding through waiver programs.  

 

Key functions and responsibilities of an F/EA:

Fiscal Management. The F/EA manages funds allocated for services under the Medicaid waiver. This includes processing payments to consumer directed attendants (making sure your attendants are paid) ensuring compliance with budgetary guidelines and overseeing financial transactions.

Enrollment Services.  Management of enrollment for EORs and attendants ~ assisting the EOR and attendant with the enrollment process. Handle the EOR request for an employer identification number.  Processes attendant employment and tax-related documents.  Submission of criminal background checks for each attendant. Answer all questions that the EOR or attendant may have about payroll and services.

Payroll Services.  The F/EA performs payroll activities on behalf of the EOR for employees hired by individuals or families utilizing self-directed services. This involves calculating wages, withholding taxes, and ensuring employees are paid accurately and on time (every 2 weeks) with the receipt of fully completed and approved timesheet.  The F/EA will also issue W-2 Statements to each attendant every January. 

Employer Responsibilities.  As the Fiscal Employer Agent, the F/EA takes on all payroll and tax responsibilities from the Employer of Record on behalf of participants who self-direct their services. This includes adhering to labor laws, and maintaining necessary employment records, filing and reporting the proper tax documentation. The F/EA will also provide quarterly reports to the EOR showing services used and services remaining. The responsibilities taken by the F/EA from the EOR, leave the EOR only with the ability to interview, hire, train and if necessary, fire an attendant.

Compliance Oversight. The F/EA ensures that all financial practices comply with federal and state regulations associated with Medicaid funding, helping avoid issues like fraud or misuse of funds.   The FEA calculates withholdings and deposit of State and Federal Income Tax, Medicare, Social Security and unemployment taxes for attendants to maintain tax compliance. File monthly, quarterly, and annual forms and tax deposits with State and Federal agencies.

Support Coordination.  For the CCC+ Waiver, the Managed Care Organization (MCO) contracts with the F/EA to ensure that payment to the attendant is accurate based upon the approved plan of care (service authorization) and timesheets that have been approved by the EOR. For the DD Waiver, DMAS contracts with the F/EA to ensure that payment to the attendant is accurate based upon the approved plan of care (service authorization) and timesheets that have been approved by the EOR.

Depending on who your MCO is, your case will be assigned to one of the following Fiscal Agents to enroll with. Your Service Facilitator will guide you to which F/EA you need to open your enrollment with and walk you through that Fiscal Agents’ enrollment steps/paperwork.

How does this work with Service Facilitation?

Your Services Facilitator (TTG) requests an authorization of hours on your behalf and submits this request to the MCO.

Once approved by the MCO or DMAS (depending on the waiver type), the authorization is then sent to the F/EA directly FROM those entities and we receive a copy of this authorization.

The MCO/ DMAS’s computer system sends the approved authorization directly to the F/EA’s computer system and we simply receive a copy of this authorization for the files.

Once the F/EA has the approved authorization in their system, the Fiscal Agent then opens up their portal for your paid attendants to submit their time entries (just like clocking in at any job), and the attendants are paid accordingly via every two weeks schedule once their time entries are approved by the EOR.

Reporting Requirements:
F/EAs are responsible for submitting necessary reports related to expenditures and other financial documents required by Medicaid authorities in Virginia.
